This application for grant of regular bail arises out of Pusa P.S. Case No. 23 of 2020 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.
It is the case of the prosecution that a total of 821.760 litres of Indian made foreign liquor was recovered from a Magic van and a Hundai car. The occupants of the two vehicle had attempted to flee away. The petitioner was apprehended on chase.
Learned counsel appearing on behalf of the petitioner has submitted that even as per the case of the prosecution the petitioner was not apprehended at the place of recovery, rather
Patna High Court CR. MISC. No.21404 of 2020(3) dt.03-07-2020 2/2 he was apprehended on chase from a nearby maize field. He has also submitted that the petitioner has no criminal antecedent. Be that as it may, considering the allegation of recovery of huge quantity of illicit liquor and the petitioner's arrest on chase by the police, I am not inclined to grant him regular bail for the present.
This application is accordingly dismissed.
However, the petitioner shall be at liberty to renew his prayer for regular bail after six months, if, in the meanwhile, there is no substantial progress in the trial. (Chakradhari Sharan Singh, J) Rajesh/- U T
