JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-06-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 504, 386, 387, 34 of the Indian Penal Code. The prosecution case is that on 31.03.2016 at about 7:30 P.M when the informant was returning to his house the petitioner along with four other persons abused and assaulted the informant and demanded Rs. 50,000/- as extortion. The informant paid Rs. 4870/- to the petitioner but thereafter petitioner further demanded Rs. 15,000/- within two days otherwise life threatening was given.
It is submitted by learned counsel for the petitioner that informant is agnate of the petitioner and Title Suit No. 672 of 2014 was filed by the petitioner wherein the informant is party defendant but he did not appear. It is further submitted that 107 Cr.P.C proceeding was also initiated
Patna High Court Cr.Misc. No.25400 of 2016 (2) dt.23-06-2016 2/2 between the parties. The petitioner is retired railway employee having no criminal antecedent. A statement to that effect has been made in para 3 of the petition.
Considering the accusation in the background of litigated relationship between the parties coupled with the statement in para 3 of the petition that petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Vth, Begusarai in connection with S. Kamal P.S. Case No. 51 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
