Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Maner P.S. Case No. 321 of 2020 registered for offence punishable under sections 341, 323, 307, 504, 506 read with 34 of the Indian Penal Code.

As per allegation, petitioner no. 1 assaulted the grand-father of the informant on his head and petitioner no. 2 assaulted the aunt of the informant.

The learned counsel for the petitioners, Mr. Patanjali Rishi has submitted that both the petitioners are innocent and they are persons of clean antecedents. Although, in the order of

No.32680 of 2021(2) dt.31-03-2022 2/2 the learned Additional Sessions Judge-III, Danapur, Patna, it was mentioned that injured Shivprasad received injury on his head, but the nature thereof has not been mentioned. Considering the above mentioned facts and circumstances, specially the clean antecedent of the petitioners, let the petitioners above named, in the event of their arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Danapur, Patna in connection with Maner P.S. Case No. 321 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.

Further condition is that at the time of surrender, the petitioners shall furnish an affidavit that in future, they shall not indulge in similar type of offence. Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
