The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code As per the prosecution case, the informant who was traveling with Rs. 7,50,000/- withdrawn from the Bank and which was kept in a bag in the dickey of his motorcycle, was robbed by three accused persons on the point of a firearm. It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in the confessional statement of co-accused Ujjawal Kumar made before police and also in the confessional

Patna High Court CR. MISC. No.24241 of 2022(3) dt.12-01-2023 2/2 statement of co-accused Ankit Kumar. No incriminating article has been recovered from the petitioner's possession. Ankit Kumar has been enlarged on bail vide order dated 28.9.2022 passed in Cr. Misc. no. 13805 of 2022. The petitioner is in custody since 23.12.2021 and charge sheet has been submitted in the case. He has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the material that has transpired in course of investigation, grant of bail to the above mentioned coaccused, the petitioner not having been put on T.I. Parade inspite of being in custody since 23.12.2021 and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Derni P.S. Case no. 151 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Saran at Chapra.
