ANJANA MISHRA ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 25(1B)A, 26/35 of the Arms Act. Learned counsel for the petitioner submits that admittedly the weapon was recovered from the possession of one Gugul who has named the petitioner as one of the persons who had also been present at the place of occurrence at the time when indiscriminate firing was allegedly made. Except that the two apprehended persons had disclosed the name of the petitioner, there is no recovery from the petitioner's possession.
In view of the present facts and circumstances of the
Patna High Court Cr.Misc. No.27699 of 2017 (2) dt.01-07-2017 P2/2 case and that admittedly the name of the petitioner has occurred in the statement made before the Police, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea, in connection with K. Hat (Sahayak) P.S. Case No. 250/2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
