The petitioners are apprehending their arrest in a case registered for the offence punishable under sections 341, 323, 379, 307/34 of the Indian Penal Code.

Prosecution case is that four accused persons including the petitioners came and assaulted the informant, her husband and other family members and snatched the jewellery. It is submitted by the learned counsel for the petitioners that in the background of the land dispute the accusation has been levelled. The injury on the person of the informant and the daughter of the informant has been found to be simple in nature. The accusation is omnibus and general. The injury report of the husband has not been brought on record.

Patna High Court Cr.Misc. No.25414 of 2016 (2) dt.23-06-2016 Considering the omnibus and general nature of accusation, let the petitioners, abovenamed, be released on provisional bail for a period of four months, in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M. III, Katihar in Kursela P.S.Case No. 11/2016, subject to the conditions as laid down under section 438(2) of the Cr.P.C.

The learned court below will confirm the provisional bail of the petitioners if it is found that no grievous injury has been caused to the husband of the informant.
