ANJANA MISHRA ORAL ORDER 12-01-2016 Heard learned Counsel for the petitioners and learned counsel appearing on behalf of the State. Petitioners apprehend their arrest in connection with Moffasil P.S. Case No. 175 of 2015 for offences alleged under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code.
Learned counsel for the petitioners submits that there is a case and counter case between the parties on account of
Patna High Court Cr.Misc. No.47043 of 2015 (3) dt.12-01-2016 2/2 previous enmity and land dispute. It is further submitted that there have been injuries on both sides and the grievous injury referred to is thumb injury. He further submits that all these petitioners have no criminal antecedent and also there was no intention/motive to kill anyone, the dispute arose only on account of passage (Rasta). Considering the aforementioned facts and circumstances and also that the petitioners have no criminal antecedent, let the petitioners, namely, Sant Kumar Singh, Satish Kumar Singh @ Satish Singh, Aplendra Kumar Singh, Dewanand Singh, Anil Singh @ Anil Kumar Singh in Criminal Misc. No. 47043 of 2015 and petitioner, namely, Sangesh Kumar Singh in Criminal Misc. No.
47680 of 2015, in the event of their arrest or surrender before the court below within a period of 4 weeks from the date of receipt/production of copy of this order, be released on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Moffasil P.S. Case No. 175 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
