JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-06-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 504, 323, 387, 506 of the Indian Penal Code.
The prosecution case is that on 24.12.2015 the petitioner abused and assaulted the informant in drunken condition and demanded extortion.
It is submitted by learned counsel for the petitioner that for the occurrence of 24.12.2015 the F.I.R was registered on 11.04.2016, whereas the petitioner filed Complaint Case No. 4 of 2016 on 04.01.2016 levelling accusation against the informant under Sections 406, 408, 420 of the Indian Penal Code which came to be registered as Dhaka P.S. Case No. 86 of 2016 and thereafter the case has been registered on 11.04.2016.
A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.25396 of 2016 (2) dt.22-06-2016 2/2 petition that petitioner has no criminal antecedent. Considering the delayed lodging of the case and the case lodged by the petitioner against the informant at earlier point of time, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sikrahna at Dhaka, Motihari in connection with Dhaka P.S. Case No. 86 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
