The petitioner apprehends his arrest in connection with N.D.P.S. Case No. 2A of 2016 arising out of Udwant Nagar P.S.

Case No.

of registered under Section 20(B)(ii)(c)/22(c) of the N.D.P.S. Act.

Learned counsel appearing on behalf of the petitioner submits that on perusal of Annexure nos. 2 to 4 to the application, it appears that nothing incriminating has been recovered from the possession of the petitioner and his name has come in the case by the co-accused Wasim. In fact, huge quantity of Ganja was recovered from the house of Md. Badruddin, father of co-accused Wasim, in which petitioner was made a seizure list

Patna High Court Cr.Misc. No.29127 of 2017 (5) dt.20-09-2017 2/2 witness and since then he was inimical term with him and petitioner was dragged in the case. Further submission is that nothing adverse was found against the petitioner in the police record, as detailed in Annexure-5 to the application. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the District and Sessions Judge, Bhojpur at Ara in connection with N.D.P.S. Case No. 2A of 2016 arising out of Udwant Nagar P.S. Case No. 93 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) Shailendra/- U T
