====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-06-2016 The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420 and 409 of the Indian Penal Code.

The prosecution case is that the vigilance enquiry was initiated in pursuance to an order of a Division Bench of this Court passed in a PIL with regard to illegal appointment of Panchayat Teachers, consequently the investigating agency directed all the Panhayat Secretaries to submit folder, confirming educational certificates and other documents of such alleged panchayat teachers, but the petitioner failed to submit the same. It is submitted by learned counsel for the petitioner that the petitioner was not given charge of the main folder of such appointment and whatever was available, the petitioner submitted

Patna High Court Cr.Misc. No.25472 of 2016 (2) dt.23-06-2016 2/2 the same to Block Educaiton Officer, Pratapganj on 26.04.2015. Report submitted by the petitioner has been brought on record as Annexure-2.

Considering the nature of accusation, let the petitioner above named be released on anticipatory bail, in the event of his arrest or surrender before the Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Birpur, Supaul in connection with Pratapganj P.S. Case No. 23 of 2016 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The bail bonds of the petitioner will be accepted by the learned court below on filing affidavit to the effect that he will co-operate in the investigation. The non-cooperation in investigation will give liberty to the learned court below to cancel the bail bonds of the petitioner.
