Mr.Satya Nand Shukla, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 09-05-2025 Heard Mr. Shivanand Singh, learned counsel appearing on behalf of the petitioner and Mr.Satya Nand Shukla, learned APP for the State.
2. Petitioner seeks regular bail in connection with Sessions Trial No.402/2022 arising out of Bidupur P.S. Case No. 56/2021 registered for the offences punishable under Sections 412 of the Indian Penal Code but chargeshhet was submitted and framed under Sections 395, 412 and 120(B) of the Indian Penal Code.
3. Learned counsel appearing on behalf of the petitioner submitted that earlier the petitioner was granted regular bail by this Court vide order dated 14.02.2025 passed in Cr. Misc. No.9279 of 2025, but his bail bond was not accepted
Patna High Court CR. MISC. No.24248 of 2025(3) dt.09-05-2025 2/3 due to incorrect criminal antecedent mentioned in paragraph no.3 thereof. Learned counsel further submitted that petitioner has now given the correct information with respect to the criminal antecedent of petitioner in paragraph no.3 in the present bail application. Petitioner is in custody since 22.02.2021.
4. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

In the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions JudgeXIV, Vaishali at Hajipur in connection with Sessions Trial No. 402 of 2022 arising out of Bidupur P.S. Case No. 56 of 2021, subject to the following conditions:
(i) Bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.
(ii) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court. (iii) If the petitioner tampers with the evidence or the
Patna High Court CR. MISC. No.24248 of 2025(3) dt.09-05-2025 3/3 witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (iv) If the petitioner is found involved in similar nature of offence, after his release on bail, the trial Court shall take steps to cancel his bail bond.
(v) The learned District Court is directed to verify the criminal antecedent of the petitioner as stated in paragraph no. 3 of the bail application. If any other case is pending against the petitioner as what has been stated in paragraph no. 3, this order will lose its force automatically.
