JUSTICE ARUN KUMAR ORAL ORDER 12-06-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends her arrest in connection with Complaint Case No.2674C of 2015, giving rise to Trial No.569 of 2016, registered under Sections 420, 467, 468 and 120(B) of the Indian Penal Code.

Allegation in brief is that the petitioner was at serial no.1 in the merit list for appointment to the post of Sevika in Aanganwari and the complainant's name stood at serial no.2. It is alleged that some forgery was made in the birth certificate of the petitioner; in connivance with the appointing authorities she was appointed as Sevika.

No.20455 of 2017 (4) dt.12-06-2017 2 / 2 Learned counsel for the petitioner submits that after verifying the genuineness of her birth certificate and other documents, she was appointed as Sevika being found at serial no.1 in the merit list and as the complainant stood at serial no.2 in the merit list so she could not be selected so on account of personal grudge filed this complaint moreover she has no locus standi to file such petition.

Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Complaint Case No. 2674C of 2015, giving rise to Trial No.569 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
