The petitioner has preferred this application for grant of regular bail in a case registered under sections 363, 366A and 34 of the Indian Penal Code.

As per the prosecution case, it is stated by the informant that his minor daughter was taken away by the accused persons including the petitioner herein. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The daughter of the informant returned and her statement was recorded under section 164 Cr.P.C which has been brought on record as Annexure -2 to the petition. From perusal of the same it would transpire that she is a major and she categorically states

Patna High Court CR. MISC. No.36023 of 2021(2) dt.17-12-2021 2/2 therein that she had gone with the petitioner out of her own free will and they married in a temple. She further states that she wants to go to her sasural. The petitioner is in custody since 16.3.2021 and has no criminal antecedent.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the statement of the victim under section 164 Cr.P.C and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Sheohar P.S. Case no. 180 of 2019 (F.R. no. 747 of 2019) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheohar.
