2. The petitioner seeks bail in a case registered for the offence punishable under Sections-302, 201/34 of the Indian Penal Code.
3. It is alleged that the informant's brother used to work in the chicken shop at Balua Bazar. Allegedly, the dead body of the informant's brother was found lying in the water near the gate of big canal ward No. 9.
4. It has been submitted on behalf of the petitioner that the petitioner is not named in the FIR. On the basis of suspicion, five persons namely, Birendra Sah, Dhiraj Kumar, Pappu Bhagat, Chhotu Bhagat and Badku Bhagat have been
Patna High Court CR. MISC. No.23999 of 2025(3) dt.06-08-2025 2/2 named in this case. So far as the petitioner is concerned, the independent witnesses in paragraphs-17 & 18 have also not named the petitioner, neither his name finds place in the FIR.
5. Learned APP has opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Araria in connection with Raniganj P.S. Case No. 340 of 2023 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
