JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 10-11-2015 The petitioner apprehends his arrest in a case under sections 379, 354 and other allied sections of the Indian Penal Code on the allegation that he being armed entered into the house of the informant and started to drag him out of the house to kill, which was objected by his wife. Thereafter, he pulled the Sari of his wife, snatched her gold chain, picked up Rs.10,000/- and demanded extortion of Rs.2,00,000/-.
The petitioner submits that there is exaggeration in the FIR and allegation under section 354 of the Indian Penal Code as well as allegation of theft is after thought. Further, parties have compromised the matter.
Counsel for the State submits that there are cases against the petitioner.
Prayer for bail of the petitioner is refused with
Patna High Court Cr.Misc. No.48906 of 2015 (2) dt.10-11-2015 2/2 direction to surrender and seek regular bail, which would be disposed of on its own merit without prejudice, also taking into consideration the compromise.
