ANJANA MISHRA ORAL ORDER 16-02-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Gobindganj P.S. Case No.182 of 2015 for allegedly having committed the offence under Sections 302 and 201/34 of the Indian Penal Code.

Case diary in the present case was called for, which has since been received.

Learned counsel for the petitioner submits that a bare perusal of the F.I.R. itself reveals that the main allegation is against Singhashan Ram, the husband of the deceased lady. It is further submitted that at best the two brothers, who are also named accused persons, could have been said to be responsible

However, in view of the fact that there is no eyewitness to the occurrence and that there is no further cogent materials in the case diary, save and except the hearsay witness, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sadar Motihari (East Champaran), in connection with Gobindganj P.S. Case No.182 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
