The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 457, 380 of the Indian Penal Code.
As per the prosecution case, on the alleged date and time of occurrence, this petitioner along with one unknown person entered the house of informant and committed theft of valuables and cash.
It is submitted that no such occurrence as alleged in the FIR has taken place. In fact, both parties are close door neighbour and due to petty dispute this false and fabricated case has been lodged by the informant. Moreover, FIR has been lodged after delay of four days for which there is no

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 09 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
