JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-01-2019 This is an application for grant of anticipatory bail in connection with Fesar P.S. Case No. 57 of 2015, disclosing offences under Sections 341, 342, 323, 324, 504, 307, 34 of the Indian Penal Code.
Allegation against the petitioners is of assault to the informant and causing injury to him.
Submission of learned counsel for the petitioners is that they have falsely implicated in this case and the allegation of assault is against other accused persons, which will appear from the fact that police after investigation submitted final form of the case and not finding the case true, but the cognizance has been taken against them. Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad (Bihar), in connection with Fesar P.S. Case No. 57 of 2015, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
