2. The petitioner is apprehending arrest in connection with Guthani P.S. Case No. 221 of 2021 instituted under Sections 341, 307, 325, 379, 323, 324/34 of the Indian Penal Code lodged on 12.09.2021 by the informant, Manoj Nath Tiwary.

3. As per the prosecution story, the informnat alleged that while coming from 'Bhuthani Bazar', the accused persons sitting there, assaulted him. The allegation against Digvijay Nath Tiwary is of giving iron rod blow on his right hand while Ram Mohan Nath Tiwary (petitioner) gave Farsa blow on the head causing injury. Further, Kameshwar Nath Tiwary gave

Patna High Court CR. MISC. No.25849 of 2025(2) dt.07-05-2025 2/2 indiscriminate blow through 'lathi' as a result whereof, he fell down on the ground. The allegation of taking away the cash and chain are also there. This led to the FIR.

4. Learned counsel for the petitioner submits that exaggerated FIR is there, implicating each and every person.

5. However, learned APP pointed out that he was shifted to Primary Health Center for treatment, injury report is there and some of them have been found to be grievous in nature. Last submission is that the matter is of year 2021.

6. Considering the submissions of the parties as also that the allegation has come coupled with the fact that he had delayed coming to the Court by four years, it would be appropriate to seek bail.

7. The anticipatory bail stands rejected.
