JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 09-11-2015 The petitioner apprehends his arrest in a case under section 307 and other allied sections of the Penal Code on the allegation that he gave knife blow on the head of the informant causing incised wound 2" x 1⁄4" skin deep on the top of skull. The petitioner submits that there is a case and counter case between the parties. However, parties have compromised the matter.

The bail petition is disposed of with following observations:- The petitioner should surrender and pray for regular bail within a period of five weeks from today. If on surrendering the informant accepts the factum of compromise, the petitioner would be released on bail in PS.Case No. -27 Year- 2014 Thana -BELA District- SITAMARHI, to the

Patna High Court Cr.Misc. No.48855 of 2015 (2) dt.09-11-2015 2/2 satisfaction of Chief Judicial Magistrate, Sitamarhi. In case, he does not accept the factum of compromise, the bail petition would be disposed of on its own merit preferably on the same day, also taking into consideration that there is case and counter case between the parties.
