JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-01-2019 This is an application for grant of anticipatory bail in connection with Aurangabad (Mufassil) P.S. Case No. 147 of 2018, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act 2016.

Allegation is of recovery of 480 liters of country made liquor from the Pickup van and the petitioner is owner of the said vehicle.

Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and he has no knowledge about the same and actually driver was handling the vehicle.

Heard learned A.P.P. also.

Having heard both sides, in view of the recovery of huge quantity of liquor and the petitioner is the owner of the

Patna High Court Cr.Misc. No.78012 of 2018(2) dt.04-01-2019 2/2 said vehicle, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather he should surrender before the learned court below and make prayer for regular bail, which will be considered on its own merit without being prejudice by order of this Court.

Accordingly, this application is dismissed.
