The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 30(a), 30(b) and 30(c) of the Bihar Prohibition and Excise Act. It is a case of recovery of liquor from a Bhatti. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that there is no recovery of liquor from the conscious possession of the petitioner and he has no concern with the seized liquor and the petitioner has not been apprehended at the spot. He further submits that similarly situated co-accused persons have already been granted anticipatory bail by a Co-ordinate Bench of this Court passed in

Patna High Court CR. MISC. No.23880 of 2022(2) dt.31-08-2022 2/2 Cr. Misc. No. 630 of 2022 and Cr. Misc. No. 68731 of 2021 respectively.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions as well as the fact that petitioner being a lady, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran in connection with Chanpatia (Srisiya O.P.) P.S. Case No. 117 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
