In this case, the petitioners are apprehending their arrest in connection with Sheikhpura P.S. Case No. 456 of 2018 registered for offences under sections 341, 323, 324, 307, 385/34 of the Indian Penal Code and Section 27 of the Arms Act.
In the present case, there is an allegation of Rangdari of Rs. 5 lacs, when the Informant refused for the same, the accused persons, armed with lathi, rod and pistol, assaulted him. One of the accused persons, namely, Fudan Yadav resorted to firing which caused gun-shot injury on the left thigh and finger of right hand of the Informant.
Learned counsel for the petitioners has attached the
Patna High Court Cr.Misc. No.78955 of 2018(2) dt.09-01-2019 2/2 compromise petition showing that Gangal Yadav, Manoj Yadav and Hargauri Yadav have settled the score with the petitioners though the case is not compoundable.
Looking to the entire facts and circumstances of the case and the fact that both the parties are co-villagers, let the petitioners, namely, Hargauri Yadav and Manoj Yadav, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura in connection with Seikhpura P.S. Case No. 456 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioners for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
