The petitioner apprehends his arrest in connection with Lalganj P.S. Case No. 14 of 2019 registered for the offence punishable under Section 30(A) of the Bihar Prohibition of Excise (Amendment) Act, 2016.
Learned counsel for the petitioner has submitted that there is no recovery from the conscious possession of the petitioner, but in paragraph-5 of the bail petition, one case is pending against the petitioner under Section 30(a) of the Excise Act.
In the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. Accordingly,
Patna High Court CR. MISC. No.24825 of 2019(3) dt.21-08-2019 2/2 the prayer for anticipatory bail to the petitioner is hereby rejected.
