Petitioner apprehends his arrest in connection with Mansoor Chak P.S. case no. 37 of 2014 registered under Sections 363 and 365/34 of the IPC.

The younger brother of the informant was kidnapped for the purpose of marriage with the sister of the petitioner. The entire male family members have been made accuseds. Contention of the counsel for the petitioner is that he is the younger brother of the person with whom, it is alleged, the brother of the informant was married forcibly. He has also claimed to be minor. There is no criminal antecedent. Looking to the allegations and the facts evidencing from the record, I am inclined to privilege the petitioner with anticipatory bail. Let the petitioner, named above, in the event of

No.51854 of 2014 (4) dt.26-05-2015 2/2 his arrest/surrender before the learned Court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist class Begusarai in connection with Mansoor Chak P.S. case no. 37 of 2014, corresponding to Gr. No. 1888 of 2014 subject to the condition as laid down under Section 438(2) of the Cr.P.C. with following conditions:- (i) One of the bailors shall be the own/close family members of the petitioner.

(ii) As soon as the charges are framed the petitioner shall appear in person before the trial Court on the date(s) fixed at the trial. In case of default in such appearance on two consecutive dates, the trial Court shall have liberty to cancel the bail bonds of the petitioner and secure his arrest in accordance with law.
