The petitioner apprehends his arrest in Kotwali (Adampur) P.S. Case No. 798/2006, registered for the offences punishable under Sections 467, 468, 471, 420 and 120B of the Indian Penal Code. The allegation against the petitioner is that the clinic of the petitioner was registered under the Janani and Bal Suraksha scheme and the petitioner submitted a bill for Rs. 2,57,000/- for treatment of beneficiaries but when enquiry was made it transpired that the beneficiaries did not get any treatment in the clinic of the petitioner. It is submitted that the petitioner did not receive any amount. The petitioner will not claim any money from the department in lieu of treatment given to the beneficiaries. It is further submitted that although beneficiaries have admitted during course of investigation that

Considering the facts aforesaid and the fact that the petitioner will not claim any money from the department for the treatment of the beneficiaries, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
