JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 26-05-2015 Two petitioner are seek bail in anticipation of arrest in connection with Dariyapur p.s. Case No. 128 of 2012 registered under section 366(A)/34 of the Indian Penal Code. Learned counsel for the petitioner states that so far petitioner no.2 , Chhotu Kumar @ Nitiranjan Kumar @ Chhotu Singh is concerned, he has already been declared juvenile by the Juvenile Justice Court, Chapra and as such he cannot be arrested and hence has no reasonable apprehension of arrest. He seeks to withdraw the application. So far as petitioner no.2 is concerned, leave is granted.

So far Govinda Singh is concerned, he is the brother of Chhotu Kumar @ Niti Ranjan Kumar @ Chhotu Singh and one of the the accused left to be released on bail. It is submitted that all the other accused have

The very first information report falsifies the statement of the victim herself. Further in the case diary it has come that in fact the victim has love affairs with Ranjan Kumar who has already been granted anticipatory bail by the learned Sessions Judge.

Considering the aforesaid facts, the above named petitioner Govinda Singh in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in Dariyapur P.S. Case No. 128 of 2012, subject to the conditions as laid down under section 438(2) Cr.P.C.
