The petitioners seek regular bail in connection with Mokama P.S. Case No. 206 of 2018 (Special Case No. 7207 of 2018) registered for the offence punishable under Sections 30(a) and 41 of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 1980 litres of illicit liquor upon search made by the Police and the petitioners are said to have apprehended from the spot.

I have perused the bail petition and I find that it has been pleaded on behalf of the petitioners that the petitioners are neither the owner nor the driver of the seized Pick Up Bolero and as far as the petitioner no. 2 is concerned, he is having a

Patna High Court Cr.Misc. No.79396 of 2018(2) dt.11-01-2019 2/2 clean antecedent, however, as regards the petitioner no. 1, it is stated that he is accused in one other case. It is further stated that in the bail petition that the petitioners are languishing in custody since 16.11.2018.

Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court, Patna in connection with Mokama P.S. Case No. 206 of 2018 (Special Case No. 7207 of 2018).
