JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 26-05-2015 The two petitioners are brother-in-law and mother-in-law of the victim girl and apprehend their arrest in relation to Nautan P.S. Case No. 24 of 2014 registered under section 304(B)/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the victim lady has died because of burn injury, while she was making tea. Having got burn injury, she was taken by her husband to Sadar Hospital, Siwan from where she was referred to P.M.C.H and in P.M.C.H. in course of treatment she died. The husband was there all along and in fact the he received postmortem report and dead body of the deceased. The relatins of the victim girl were also present. Subsequently the first information report was

Patna High Court Cr.Misc. No.44023 of 2014 (4) dt.26-05-2015 2/2 lodged.

A supplementary affidavit has been filed annexing copy of deposition of the informant recorded in the court wherein the father of the victim girl has admitted that this was accidental death and in the hit of moment the first information report was lodged. The husband of the victim has already surrendered and since then he is in custody.

Considering the aforesaid facts, the above named petitioners in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Siwan, in Nautan P.S. Case no. 24 of 2014, subject to the conditions as laid down under section 438(2) Cr.P.C.
