Petitioner seeks bail in Basopatti P.S. Case No. 256 of 2018 instituted for the offence under Section(s) 272, 273 Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is alleged that total 4.500 Litres foreign liquor has been recovered from possession of the petitioner. Petitioner is said to be in custody since 29.10.2018. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions

Patna High Court Cr.Misc. No.79207 of 2018(2) dt.24-01-2019 2/2 Judge, II -cum- Special Judge, Excise, Madhubani, in connection with Basopatti P.S. Case No. 256 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.

From para 3, it appears that one more case under the Excise Act is pending against the petitioner. The petitioner will file an Affidavit at the time of his release that he will not indulge in such activities in future, otherwise, his bail bond in the instant case will be liable to be cancelled.
