JUSTICE SUDHIR SINGH ORAL ORDER 11-07-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Sahebpur Kamal P.S. Case No. 58 of 2016 for the offences instituted under Sections 366(A), 364 and 372 of the IPC. The prosecution story, in brief, is that all the accused persons forcibly caught the minor daughter of the informant, namely, Amrita Kumari, and taken away on a Bolero vehicle towards Begusarai. The informant has every confidence that the

Patna High Court Cr.Misc. No.27265 of 2016 (2) dt.11-07-2016 2/2 accused persons enticed his daughter with an intention to commit murder her or to sell for brothel.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. The date of occurrence is 28.03.2016 and the complaint was filed on 02.04.2016. The delay has not been explained by the prosecution. The victim girl has been examined under Section 164 Cr. P.C. where she has denied the allegations made in the complaint case. On behalf of the State it has been submitted that the petitioners are named in the complaint case/F.I.R. Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Sahebpur Kamal P.S. Case No. 58/2016 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
