JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-07-2019 This is an application for grant of anticipatory bail in connection with Mahindwara P.S. Case No. 1 of 2019, disclosing offences under Sections 364/34 of the Indian Penal Code.

Allegation of abduction of the wife of informant by the petitioners and it has also stated that she use to visit the house of one Asma Khatun and he suspects that they have taken her for illicit relationship purpose.

Submission of the learned counsel for the petitioners is that whatever the allegation is that i.e. against Asma Khatun that she visit to her house and the allegation is false and

Patna High Court CR. MISC. No.26116 of 2019(4) dt.05-07-2019 2/2 concocted as the F.I.R. itself shows that she is major. Heard learned A.P.P. as well as learned counsel for the opposite party no.2 also, who has opposed the prayer for bail on the ground that she is still trace-less.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Mahindwara P.S. Case No. 1 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with further condition that they have to co-operate in the investigation.
