In this case, the petitioner is seeking anticipatory bail in connection with Shahkund P.S. Case No. 80 of 2016 registered for offences under sections 379, 447, 290/34 of the Indian Penal Code.

Allegation has been made that the Mines Development Officer has lodged the case on the allegation that J.C.B. Dumper have been used for breaking the stones for the purposes of sale and purchase, but save and except J.C.B. Dumper and tractor no minerals were recovered from the possession of the petitioner.

Looking to facts and circumstances of the case, the

Patna High Court Cr.Misc. No.26887 of 2016 (2) dt.05-07-2016 2/2 petitioner, above named, in the event of arrest or surrender before the court below within a period of four weeks, be enlarged on bail on his furnishing bail bond of Rs.10,000/-with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Bhagalpur in connection with Shahkund P.S. Case No. 80 of 2016, subject to the condition as laid down under Section 438 (2) Cr. P.C.
