Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offence alleged under Section 135 of the Electricity Act, registered in connection with Kutumba P.S.Case No. 205 of 2020.

As per allegation, due to electric theft committed by the present petitioner, the Electricity Department sustained a loss of Rs. 3,05,776/-.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.32715 of 2021(2) dt.31-03-2022 2/2 that the entire allegation is false, but at the same time, he has submitted that the petitioner may deposit 25% of the amount subject to the final outcome of the case.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Electricity) Magadh Range, Gaya in connection with Kutumba P.S.Case No.205 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C. with further condition that at the time of surrender, the petitioner has to submit a receipt of deposit of Rs. 76,444-/ which is 25% of the entire amount.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
