====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 01-12-2021 Heard the learned Advocate for the petitioners and the learned APP for the State.

The petitioners seek bail in connection with Baisi P. S. Case No.35 of 2021, Special Excise Case No.81 of 2021 instituted for the offences under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 41, 47 of the Bihar Prohibition and Excise Act, 2016.

The learned counsel for the petitioners submits that the petitioners are in custody since 29.01.2021, they are persons with clean antecedents and charge-sheet has been submitted in this case.

Allegation is of recovery of 418.380 litres of liquor

Patna High Court CR. MISC. No.33922 of 2021(2) dt.01-12-2021 2/2 from two Bolero vehicles.

Learned counsel for the petitioners submits that petitioners are driver of the said Bolero vehicle and they were not knowing what was being carried in the said vehicle. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioners are in custody since 29.01.2021, they are persons with clean antecedents and charge-sheet has been submitted in this case, the petitioners, above-named, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Purnea in connection with Baisi P. S. Case No.35 of 2021 in Special Excise Case No.81 of 2021.

The application stands allowed.
