The matter has been taken up through video conferencing.

The petitioner seeks bail in Nathnagar (Madhusudanpur) P.S. case No. 148/ 2020 (NDPS case No. 09/2020) registered u/s 20 & 22 of the N.D.P.S. Act. The petitioner was going on a motor cycle and on search one kg of Ganja was recovered from the possession of the petitioner.

The learned counsel for the petitioner submits that of course 1000 gm of Ganja is small quantity and from one kg to 20 kg of Ganja is described as less than commercial quantity and for recovery of small quantity of Ganja the punishment is

Patna High Court CR. MISC. No.21354 of 2020(2) dt.12-08-2020 2/2 only up to six months. It is submitted that for recovery of one kg Ganja the petitioner is in custody since 07.03.2020. The petitioner has already remained in jail for more than five months.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-X, Bhagalpur in connection with Nathnagar (Madhusudanpur) P.S. case No. 148/ 2020 (NDPS case No. 09/2020).
