The petitioner seeks bail in connection with Neema Chandpura P.S. Case No. 104/2018 registered under Section 392 of the Indian Penal Code.
Three motorcycle borne criminals are said to have snatched motorcycle and bag containing P.A.N card, A.T.M. card etc. of the informant. Co-accused Saurabh Kumar was apprehended with the looted motorcycle, who named the petitioner as one of his accomplices.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. Petitioner has no concern
Patna High Court CR. MISC. No.23821 of 2019(2) dt.12-04-2019 2/2 with the aforesaid occurrence. There is nothing on record indicating complicity of the petitioner in the occurrence barring the confessional statement of Saurabh @ Sanjeev Kumar. Petitioner was not apprehended on the spot and was not put on T.I.P. He has been languishing in custody since 01.12.2018. On the other hand, learned A.P.P. opposed the bail prayer of the petitioner.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 6th, Begusarai in connection with Neema Chandpur P.S. Case No. 104/2018.
