Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered under Sections 448, 341, 323, 307 and 504/34 of the Indian Penal Code.

The prosecution case, in brief, is that on the alleged date on the occurrence while the informant was sitting in her home, then the accused persons including the petitioners entered in her house and started to abuse and assault and during course of assault she sustained injury in her hand and over head.

No.28560 of 2017 (2) dt.01-07-2017 2/2 It has been submitted on behalf of the petitioners that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioners have falsely been implicated in the present case. The petitioner No.1 and 2 are ladies and petitioner No.3 is the husband of petitioner No.1. The alleged occurrence is said to have taken place due to family dispute. Nature of injury is said to be simple. General and omnibus allegation has been made. No specific injury has been attributed against the petitioners. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Aurangabad in connection with Haspura P.S. case No.198 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
