JUSTICE ARUN KUMAR JHA ORAL JUDGMENT Date : 02-12-2024 Heard learned counsel for the petitioner as well as learned counsel for the respondent nos. 2 to 7 and I intend to dispose of the present petition at the stage of admission itself.

02. The petitioner has approached this Court seeking direction to the learned Sub Judge-I, Aurangabad for expeditious disposal of Title Suit No. 490 of 2016.

03. Learned counsel for the petitioner submits that the title suit filed by the plaintiffs/respondents-1st set has been pending since 2016 and the petitioner is the contesting defendant who has appeared and filed his written statement. But the plaintiffs have no intention of getting the title suit disposed of and only to disturb the possession of the defendant/petitioner, they have filed Title Suit No. 490 of 2016.

04. Learned counsel appearing on behalf of respondent nos. 2 to 7 has no objection to expeditious disposal of Title Suit No. 490 of 2016.

05. Since the petitioner has approached this Court with limited prayer for expeditious disposal of Title Suit No. 490 of 2016 pending before the learned Sub Judge-I, Aurangabad, I do not think there is any need to issue notice to the other respondents as early disposal of civil cases is in larger public interest.

06. Therefore, the learned trial court is directed to take up the matter of Title Suit No. 490 of 2016 for early disposal and try to dispose of the same preferably within a year from the date of receipt/production of a copy of this order, without granting unnecessary adjournment in the matter. Moreover, both sides have agreed to co-operate in the proceeding of Title Suit No. 490 of 2016.

07. Accordingly, with the aforesaid direction, the present petition stands disposed of.
