====================================================== CORAM: HONOURABLE MR. JUSTICE KHATIM REZA ORAL ORDER 24-05-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Pirpainti P.S. Case No. 44 of 2023 dated 03.02.2023 instituted for the offence punishable under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.

3. The allegation against the petitioner is that she in collusion with other unknown persons has produced the forged mark-sheet as original for being appointed on the post of untrained teacher.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. Learned counsel for the petitioner submits that the petitioner is suffering from mental disease and is being treated at Central Institute Psychiatry, Kanke, Ranchi, documents of which is annexed as Annexure-2 series. Learned counsel for the petitioner submits that

No.26479 of 2023(2) dt.24-05-2023 2/2 no witness has supported the prosecution case rather she has been implicated in the present false case on the behest of the authorities and their ill motive and intention just to safe-guard himself from the allegation by implicating the petitioner in the present case and nothing incriminating has been recovered from the conscious possession of the petitioner. It is further submitted that the petitioner herself has resigned from the said post due to her medical condition even before the order passed by this Hon'ble Court. Lastly, it has been submitted that the petitioner is in custody since 09.02.2023 having no criminal antecedents. Charge-sheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhagalpur, in Pirpainti P.S. Case No. 44 of 2023.
