2. This is an application for grant of anticipatory bail on behalf of the above named petitioners who apprehends their arrest in connection with Rajgir P.S. Case No. 510 of 2024 for the offences under sections 126(2), 115(2), 117(2), 109(1), 329(4), 76, 303(2), 352, 351(2), 3(5) of the BNS.

The prosecution case, in brief, as contained in the written report of informant Saroj Devi is that on 02.11.2024, while the informant and her minor daughter were working at her home, Mithu Chaudhary and Bhushan Choudhary trespassed into the house of informant in drunken condition. It is alleged that Minthu Chaudhary started molesting the informant and

When she raised an alarm, the petitioners entered into her house and assaulted her. Petitioner no. 1 and petitioner no. 2 severely assaulted the informant with Khanti and Brick causing fracture of her hand and leg. In the meantime, Sulochana Devi snatched silver chain and silver ring from the informant. Mithu Chaudhary took out Rs. 6,660/- cash, jewellery and clothes from the box.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. He has further submitted that there is a petty feud regarding flow of drainage between the parties and the injuries sustained are simple in nature. The allegations leveled against the petitioners are general and omnibus. He has also submitted that the petitioners are the persons of clean antecedents.
5. On the other hand, learned counsel for the State has opposed the prayer for bail.
6. Considering the above-mentioned facts and circumstances, let the petitioner no. 2, in the event of his arrest or surrenders within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten
Patna High Court CR. MISC. No.23442 of 2025(4) dt.11-12-2025 3/3 Thousand) with two sureties of the like amount to the satisfaction of learned CJM, Nalanda at Biharsharif in connection with Rajgir P.S. Case No. 510 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C.
7. So far as petitioner No. 1, is concerned, he is alleged to have entered into house of the informant who is a widow and of assaulting her. Accordingly, their prayer for anticipatory bail is rejected.
