Apprehending his arrest in Bibhutipur P.S. Case No. 211 of 2014 registered under section 394 IPC, the petitioner has filed the present application for grant of anticipatory bail. The informant is the bank official. It has been alleged that while he was going to the bank, three persons riding a motor cycle overtook and stoped him. The accused persons assaulted the informant and snatched the bag containing cash. The mobile phone was also snatched. A week thereafter two accused persons were arrested who, in their respective confessional statements, gave out the name of the petitioner.

The contention of the petitioner is that it is a case based

Patna High Court Cr.Misc. No.49100 of 2015 (2) dt.05-11-2015 2/2 on the confessional statements before the police. The petitioner has no criminal antecedent.

Mr. Dayal, on the other hand, states that during investigation witnesses have supported the case and I.O. having found substantial evidence has also submitted the charge sheet. Considering the submissions of the parties, I am not inclined to grant the privilege of bail to the petitioner. His prayer is rejected. He should surrender and seek regular bail which shall be considered by the court below on its own merit. (Kishore Kumar Mandal, J) HR/- U T
