The appellant seeks anticipatory bail in connection with A.B.P. No. 2873 of 2018 arising out of Bettiah Sadar S.C./S.T. P. S. Case No. 42 of 2018, registered for offences punishable under Sections 341, 323, 354, 504, 506/34 of the Indian Penal Code and Sections 3(1) (r) (w) 3 (2) (va) of the SC/ST Act.

The allegation as per the F.I.R. against the appellant is that the appellant and others is of trying to outrage of modesty of the informant and thrashing her on the ground and assaulted with fists, slaps and stick and abusing her by caste name. Submission of the learned counsel for the appellant is that he is sole appellant and no specific allegation has been

Having heard both sides and in view of the facts and circumstances, as stated above, let the appellant, above named, in the event of arrest or surrender before the Court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge- cum-Special Judge, West Champaran, Berttiah in connection with Bettiah Sadar S.C/S.T. P.S.Case No. 42 of 2018, subject to condition as laid down under Section 438 of CR.P.C.

With the aforesaid direction, this appeal is allowed and the impugned order is set aside.
