JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-09-2022 Supplementary affidavit has been filed by learned counsel for the petitioner submitting that by mistake, in the prayer portion of the bail petition, description of district has wrongly been mentioned as 'Sarsan at Chapra' in place 'Saran at Chapra'.

Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Sections 147, 148, 323, 420, 467, 468, 471/34 of the Indian Penal Code.

As per the prosecution case, all the accused persons including petitioner under conspiracy, fraudulently sold the land of the mother of complainant by two registered sale deed in order to grab the land of complainant.

Learned counsel appearing for the petitioner submits

Patna High Court CR. MISC. No.26100 of 2022(2) dt.20-09-2022 2/2 that petitioner is innocent and has falsely been implicated in the case. He submits that allegation of execution of sale deed is against co-accused Puran Singh. Similarly situated co-accused have already been allowed bail by this Court vide orders passed in Cr.Misc.No. 44835/2021 and 3058/2022. It is also the case of the petitioner that the dispute is of civil nature. Learned counsel appearing for the State opposes the prayer for anticipatory bail submitting that the petitioner is one of the conspirators in the case.

Considering the aforesaid facts of the case, let the petitioner, above named, in the event of his arrest/ surrender within a period of four weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VI, Saran at Chapra in connection with Complaint case No. 343/2020, subject to conditions laid down u/s 438(2) of the Cr.
