02. In the present case, the petitioner seeks bail in connection with Vaishali Cyber P.S. Case No. 68 of 2024, registered for the offences under Sections 303(2), 318(2), 318(4), 319(2), 336(3), 336(3), 340(2), 61(2) and 3(5) of the B.N.S. and Section 66B, 66C and 66D of the Information Technology Act.

03. As per the prosecution case, police located two mobile numbers used in cyber fraud and a raid was conducted and this petitioner along with other co-accused persons was apprehended by the police. Recovery of two mobile phones, Aadhar Card, ATM card etc. was made from this petitioner.

04. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.23476 of 2025(2) dt.02-05-2025 2/3 petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner was looking for a job and got a job offer through a social site by one Dheeraj Kumar @ Krishna and when he went to the said place of job, he was arrested along with the co-accused persons. Further, the mobile phone complained of was recovered from the co-accused persons and not from possession of this petitioner. Learned counsel further submits that petitioner is student and is having antecedent of one case, in which he is on bail. The co-accused person has been granted bail by this Court vide order dated 01.05.2024 passed in Criminal Misc. No. 23858 of 2025. The petitioner is in custody since 22.12.2024 and charge sheet has been submitted.

05. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner. Learned A.P.P. submits that the mobile of the petitioner was found involved in committing cyber cheating and the petitioner along with other co-accused persons was involved in a big way in cyber fraud.

06. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the submission of charge sheet and period of custody of the petitioner, the petitioner is directed to be released on bail, on

No.23476 of 2025(2) dt.02-05-2025 3/3 furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-7th, Vaishali at Hajipur/concerned court, in connection with Vaishali Cyber P.S. Case No. 68 of 2024, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions: (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
