JUSTICE RAKESH KUMAR ORAL ORDER 19-08-2017 Heard Sri Manish Chandra Gandhi, learned counsel for the petitioner and learned Additional Public Prosecutor . The sole petitioner, apprehending his arrest in Hajipur Town P.S. Case No. 214 of 2017 registered for the offence under section 272, 273, 188 of the Indian Penal Code , 1860 and section 30 / 38 of the Bihar Prohibition and Excise Act, 2016 has prayed for grant of bail in the event of arrest or surrender. It was submitted by learned counsel for the petitioner that one mineral water factory, which is in the name of father of the petitioner was searched by the Police and from there some quantity of Indian make foreign liquor was recovered and petitioner being son of the owner of the factory has been made accused.

Patna High Court Cr.Misc. No.29390 of 2017 (3) dt.19-08-2017 2/2 Considering the nature of accusation as well as the fact that the factory from where recovery was made is not in the name of the petitioner, in the event of arrest or surrender within a period of six weeks from today, let the petitioner Nishikant Thakur @ Chandan @ Nishi Kant be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge II, Vaishali at Hajipur / concerned court in connection with Hajipur Town P.S. Case No. 214 of 2017 subject to the conditions as contemplated under section 438(2) of the Code of Criminal Procedure 1973.
