JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-08-2019 This application, for grant of anticipatory bail, arises out of Bettiah Muffasil P.S. Case No. 291 of 2018, disclosing offences under Sections 341, 323, 494, 498-A/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Earlier the matter was referred to Patna High Court Mediation and Conciliation Center, Patna and report of learned Mediator is available on record, from which, it appears that the dispute between the parties has been resolved through the process of mediation on the terms and conditions reached between the parties. In which, it has been mentioned that both the parties have decided to live separately and petitioner will pay Rs. Two Lakhs to opposite party no. 2 as one time

Patna High Court CR. MISC. No.23928 of 2019(5) dt.27-08-2019 2/2 settlement and on payment of the same, opposite party no. 2 will withdraw her cases. Memorandum of agreement has been signed by both the parties including their counsels. Having heard both sides, in view of the above facts the provisional bail earlier granted to the petitioner is extended till 15.10.2019. In the meantime, learned court below shall issue notice to opposite party no. 2 and asked her to remain present in the court on 15.10.2019, on which date the petitioner will handover the bank draft of Rs. 2,00,000/- drawn in favour of opposite party no. 2 and the court below after verifying the same shall confirm the provisional bail of the petitioner, otherwise, he is free to pass any order as he deems fit and proper. With the above observation, this application is disposed of.

Let a copy of learned mediator's report along with memorandum of agreement be sent to the concerned court below forthwtih.
