The petitioner is apprehending his arrest in connection with Hajipur Town P.S. Case No. 103 of 2015 instituted for the offences under Sections 366-A and 34 of the Indian Panel Code. Allegation against the petitioner is that he abducted daughter of the informant aged about 16 years, with bad intention. It has been submitted that on behalf of the petitioner that the petitioner has got no criminal antecedent. He has falsely been implicated in the present case. The victim has been examined under Section 164 of the Code of Criminal Procedure. She has

Patna High Court Cr.Misc. No.49236 of 2015 (3) dt.08-02-2016 2/2 admitted that on her own willing, she had gone with the petitioner and has married him. They are staying together. No one has appeared on behalf of the opposite party No. 2 in spite of the fact that notices were issued to the opposite party No. 2.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with with Hajipur Town P.S. Case No. 103 of 2015 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
