The petitioner seeks bail in Kudra P.S. Case No. 333 of 2020 corresponding to Sessions Trial No. 43 of 2021, registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code and sections 25(1-b)a, 26, 27 and 35 of the Arms Act.

As per the prosecution case, on secret information that some miscreants have committed marpit and robbery from truck drivers, a raid was conducted. This petitioner and two others were apprehended by the police.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case only on suspicion. No incriminating article has been recovered from possession of this petitioner. Similarly situated co-accused

Patna High Court CR. MISC. No.34157 of 2021(3) dt.17-01-2022 2/2 Prem Pandey has been granted bail by this Court vide order dated 22.10.2021 passed in Cr. Misc. No. 18363 of 2021. Petitioner is in custody since 02.11.2020.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Kudra P.S. Case No. 333 of 2020 corresponding to Sessions Trial No. 43 of 2021.
