Case No. 74/2014 where offences punishable under sections 406, 409, 420, 467, 468, 471 and 120B of the Indian Penal Code and certain sections of the Prevention of Corruption Act and the I.T. Act were alleged.
Apprehending his arrest the petitioner filed Spl. Case No. 37 of 2014 in the court of Special Judge, Vigilance-II, Patna. The trial court dismissed the application through the order dated 55-2014. Hence, this application under section 438 Cr.P.C. Heard Mr. N. K. Agrawal, learned senior counsel for the petitioner and Mr. Ramakant Sharma, learned counsel for the Vigilance.
It is brought to the notice of this Court that out of
Patna High Court Cr.Misc. No.24634 of 2014 (3) dt.25-06-2015 2/2 twelve accused, some of them have been granted regular bail after arrest. Though it is submitted that some of the accused have also been granted anticipatory bail, particulars of which have not been furnished.
This Court is not inclined to grant anticipatory bail to the petitioner. Hence, the petition is dismissed. Having regard to the facts, it is directed that if the petitioner surrenders before the trial court and files an application for bail, the same shall be disposed of within three days taking into account the fact that other accused have been granted bail.
